By Johnson Choi on 4-17-3026 in San Francisco 中國土地所有權的迷思. 作者: 蔡永強 在美國加州三藩市 在中國買房子完全不用擔心「被趕走」這種情況。實際上，70年到期後房子不會被收回，更不會把業主趕走。 這裡有一個核心的法律概念需要釐清： · 房子永遠是你的：你購買的房產，你對房屋本身擁有所有權，這是永久的。· 70年租用的是土地：所謂的「70年」是指國有土地的使用權，並非租用房子。 關於大家最關心的「70年後怎麼辦」，根據《中華人民共和國民法典》第三百五十九條，規定非常明確： · 自動續期，無需申請：住宅建設用地使用權期滿後，自動續期。這意味著你什麼都不用做，土地使用權就自動延長了，不存在「到期被收回」的問題。 · 費用待定，但肯定不高：續期費用的具體標準雖然還在制定中，但法律明確了會有「繳納或者減免」的安排。參考行業分析，即使收費，預計標準也較低（例如每平米幾十元或按房價的極小比例）。 另外，如果房子因政府規劃等原因需要拆遷，你作為房屋所有權人，有權獲得足額的現金或房產補償。 所以，結論很明確：房子70年後依然是你的，法律已經透過「自動續期」給了大家一顆定心丸，關於費用的具體細則，後續出臺規定即可。 剛剛我和中國和香港的合作夥伴通過電話有以下補充：現在的中國法律，當七十年期的地到期後，政府續期的金額不能超過四位數字，即不能超過人民幣九千九百九十九元！不管妳喜歡中國或是中國政府與否，中國和美國不同，如果想理解有什麼不同，我們可以坐下來好好談談，用我過去五十年行走中美兩地的實際經驗和妳分享。以中國七十年期的地約為例，如果中國政府當千萬間房屋的地租到期像美國政府那樣採取發財大計，不理民間疾苦，中國必定大亂！而且也不符合社會主義，以民為本的原則。所以中國沒有像美國的斬殺線。我是一位實事求是的人，黑貓白貓捉到老鼠的就是好貓，包括政府！所以不少明眼的海外華人返回中國退休提升生活品質，活得更開心，安享晚年。
